1. Acceptance of terms

By accessing or using Markupp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of service

Markupp provides AI-powered listing analysis, rewriting, and market intelligence tools for online marketplace sellers. The Service is provided on an "as is" basis and may be updated or modified at any time.

3. User accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Acceptable use

You agree not to use the Service for any unlawful purpose, to upload malicious content, to attempt to reverse-engineer the Service, or to use automated means to access the Service beyond the permitted API limits of your plan.

5. Payments and refunds

Pay-as-you-go purchases are non-refundable once the analysis has been delivered. Subscription plans may be canceled at any time; cancellation takes effect at the end of the current billing period. Refund requests for exceptional circumstances should be directed to [email protected].

6. Intellectual property

The Markupp platform, branding, and underlying technology are owned by Markupp. Content you submit remains yours; by submitting it you grant us a limited license to process it for the purpose of delivering the Service.

7. Limitation of liability

To the maximum extent permitted by applicable law, Markupp shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of Delaware.
